These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Al Safir Airways ("Company," "we," "us," or "our"), a virtual airline operating on the Roblox platform. By accessing, browsing, or using our website, services, applications, forums, Discord servers, Roblox group, or any other means of interaction with Al Safir Airways (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization. If you do not agree, you must immediately discontinue all use. Continued use constitutes acceptance of any modifications.
From a user perspective, this means that by creating an account, visiting our website, joining our Discord, or participating in any Al Safir Airways activity, you are entering into a contract with us. You should read these Terms in full and keep a copy for your records. On our side, we rely on this agreement to operate the Services consistently, enforce rules, and protect our community and intellectual property. We maintain the right to require acceptance of updated Terms as a condition of continued access where permitted by law.
Certain features may be subject to additional terms. In the event of conflict, Supplemental Terms govern for that specific feature. For example, pilot applications, staff roles, mileage programs, booking systems, or promotional campaigns may have their own rules or eligibility criteria. We will make Supplemental Terms available at the point of use or by link. You agree that your use of those features constitutes acceptance of the applicable Supplemental Terms.
We retain the right to introduce new Supplemental Terms for new products or features. Where required by law, we will obtain your consent before applying new terms to existing use.
Your use is also subject to Roblox Corporation's Terms of Use, Privacy Policy, and Community Standards. Violations may result in termination and action by Roblox. As a user, you are responsible for complying with both Roblox's rules and ours. We do not control Roblox's policies or enforcement. If your Roblox account is restricted or banned, we may be unable to provide you with Services that depend on the Roblox platform.
On our side, we operate in good faith within Roblox's ecosystem. We will not knowingly facilitate conduct that violates Roblox's terms, and we may report serious violations to Roblox when appropriate. Our Terms are intended to complement, not replace, Roblox's terms.
These definitions apply throughout the Terms. Where the context requires, singular includes plural and "including" means "including without limitation."
You must be at least 13 years of age (or the minimum age in your jurisdiction) to use our Services. If under 18, you must have parental or guardian permission. We reserve the right to verify age and eligibility. You agree to provide accurate information and maintain account security. We may suspend or terminate your account at any time for violation of these Terms or for any reason we deem appropriate.
As a user, you are responsible for ensuring that your registration information is current and correct. You must not create more than one account per person unless we expressly allow it (e.g., separate pilot and passenger profiles where supported). You must keep your login credentials confidential and notify us promptly of any unauthorized access. We are not liable for losses resulting from your failure to protect your account.
We may suspend or terminate your account or access to any part of the Services without prior notice if we believe you have violated these Terms, engaged in fraud or abuse, harmed other users or the community, or for operational, legal, or security reasons. We may also discontinue certain features or the entire Services with reasonable notice where feasible. Termination does not entitle you to a refund of any amounts paid (if applicable) or to restoration of Virtual Items or data.
If you wish to stop using the Services, you may discontinue use at any time. You may contact us to request account deletion in accordance with our Privacy Policy. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive (including indemnification, limitation of liability, and dispute resolution) will survive termination.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. You agree NOT to: violate any applicable law; impersonate others; harass or intimidate users; post unlawful or objectionable content; cheat or exploit; gain unauthorized access; interfere with Services; use automated means without permission; reverse engineer; remove proprietary notices; sell or transfer your account.
We reserve the right to investigate violations and take action including warnings, suspension, permanent ban, reporting to Roblox, or referral to law enforcement. From a user perspective, we expect respectful and lawful behavior. Our community guidelines, as posted on our website or Discord, form part of acceptable conduct. We encourage you to report conduct that you believe violates these Terms so we can review and take appropriate action.
Prohibited conduct includes, but is not limited to: using cheats, exploits, automation, or third-party tools to gain unfair advantage; manipulating rankings, hours, or virtual currency; creating or using multiple accounts to circumvent restrictions; distributing malware or attempting to compromise our or other users' systems; scraping or harvesting data without permission; reselling or commercially exploiting access to the Services; and any conduct that we reasonably determine to be harmful to the Services or the community.
We are not obligated to monitor all content or conduct but we may do so. We may remove content, suspend or ban accounts, and take other remedial action in our sole discretion. We may cooperate with law enforcement and Roblox in investigations. We do not guarantee that we will take action in every case, and our failure to act in one instance does not waive our right to act in another. You have no claim against us for our enforcement decisions made in good faith.
You retain ownership of User Content. By posting, you grant Al Safir Airways a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, display, and distribute such content. All Company Content is owned by Al Safir Airways and protected by intellectual property laws. You may not copy, modify, or create derivative works without express written permission. The Al Safir Airways name, logo, and marks are trademarks. Any feedback you provide may be used without compensation or confidentiality obligation.
For users: the license you grant allows us to operate the Services—for example, to display your posts in our forums, show your username in leaderboards, or use your feedback to improve the Services. We do not claim ownership of your content beyond what is necessary to run and promote the Services. You represent that you have the rights to grant this license and that your User Content does not infringe third-party rights.
We invest significant resources in our branding, systems, and content. Unauthorized use of our trademarks, logos, or content may result in legal action. We may grant limited permissions (e.g., for community events or fan content) in separate guidelines. You may not use our name or branding in a manner that suggests endorsement or affiliation unless we have agreed in writing.
If you believe content on our Services infringes your copyright, you may submit a DMCA-compliant notice to our designated agent. We will process valid notices in accordance with applicable law. We may remove content and terminate repeat infringers. If you believe your content was removed in error, you may submit a counter-notice. False or bad-faith notices may result in liability.
Al Safir Airways provides a virtual airline experience within Roblox. Flight operations, rankings, hours, and game mechanics are simulations with no real-world value. We do not guarantee accuracy, availability, or continuity. Virtual rewards and achievements may be modified or removed at our discretion.
As a user, you understand that flights, miles, ranks, and other virtual elements are for entertainment only. They do not represent real aviation credentials or financial value. We may change game mechanics, routes, or rewards to improve the experience or for balance. We will use reasonable efforts to provide a fun and fair environment but cannot guarantee that the Services will be error-free or available at all times.
You may not sell, trade, or exchange Virtual Items for real money or other real-world consideration except where we expressly permit it in writing. We prohibit and do not recognize any such transactions. Attempts to commercialize Virtual Items may result in account termination and forfeiture. On our side, we do not guarantee the permanence of any Virtual Item and may discontinue or alter programs with reasonable notice where feasible.
We may perform maintenance, updates, or experience outages. We are not liable for downtime, data loss, or changes to the Services that result from technical issues, third-party dependencies (including Roblox), or operational decisions. We will strive to communicate significant planned outages when possible.
To the fullest extent permitted by law, the Services and all content are provided "as is" and "as available" without warranties of any kind. We do not warrant uninterrupted, error-free, or secure service. We do not warrant accuracy or completeness of any content. Your use is at your sole risk.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your expectations or that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in such cases our liability will be limited to the maximum extent permitted by law.
From our perspective, these disclaimers are essential to operating a free or low-cost virtual experience. We provide the Services in good faith but cannot guarantee outcomes or assume unlimited risk. Users should use the Services for entertainment and in accordance with these Terms.
To the maximum extent permitted by law, Al Safir Airways and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. In no event shall our total aggregate liability exceed the greater of (a) amounts you paid in the preceding 12 months, or (b) $100 USD. Some jurisdictions do not allow exclusion of certain damages; our liability is limited to the maximum permitted by law.
This limitation applies to all claims arising from or related to the Services, including breach of contract, tort, negligence, or any other theory. We are not liable for loss of data, loss of Virtual Items, loss of goodwill, or any indirect or consequential loss. We are not liable for the actions of other users, third-party platforms (including Roblox), or events outside our reasonable control.
For users in jurisdictions that do not allow full limitation of liability, our liability will be limited to the maximum extent permitted by applicable law. For EU consumers, nothing in these Terms affects your statutory rights under mandatory consumer protection laws.
You agree to indemnify, defend, and hold harmless Al Safir Airways and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the Services; your User Content; your violation of these Terms; your violation of third-party rights; or any unlawful conduct.
This means that if a third party sues us because of something you did or posted, you will be responsible for our costs and losses (including legal fees) to the extent allowed by law. We will notify you of any such claim and cooperate with you in the defense; you may not settle any claim that affects our rights without our prior written consent. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.
On our side, we rely on this indemnification to protect the company and our community from the consequences of user misconduct or infringement. The obligation survives termination of your account and these Terms.
Before formal proceedings, you agree to attempt informal resolution by contacting us. If unresolved, disputes shall be resolved by binding arbitration. You waive your right to a jury trial and class action. Exceptions: either party may seek injunctive relief for IP infringement; small claims matters may be exempt.
As a user, you can contact us via our Contact page to try to resolve any issue. We will work in good faith to address legitimate concerns. If we cannot resolve the dispute, the dispute will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (or equivalent), and the arbitrator's decision will be final and binding. Class arbitrations and class actions are waived to the extent permitted by law.
You may opt out of the arbitration agreement by sending us written notice within 30 days of first accepting these Terms, with your name, address, and a clear statement that you opt out. If you opt out, disputes will be resolved in the courts specified in the Governing Law section. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for intellectual property or confidential information violations.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU users, mandatory consumer protection laws of your country may apply. Any legal proceedings (to the extent not subject to arbitration) shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
We choose Delaware for reasons of consistency and predictability in our legal relations. Users outside the United States may have additional rights under their local laws; we do not waive those rights by this choice of law to the extent they cannot be waived.
We may modify these Terms at any time. Material changes will be posted with an updated date. Continued use constitutes acceptance. If you disagree, discontinue use. We will use reasonable efforts to notify users of material changes via the website, in-Service notice, or email where we have your address. The "Last updated" date at the top of this page indicates when the Terms were last revised.
From our side, we need flexibility to update Terms to reflect new features, legal requirements, or operational needs. Where the law requires affirmative consent to material changes (e.g., for certain EU consumers), we will seek such consent. Your continued use after the effective date of changes constitutes acceptance except where prohibited by law. If you do not accept the new Terms, you must stop using the Services and may request account deletion in line with our Privacy Policy.
These Terms, with our Privacy Policy, constitute the entire agreement. If any provision is invalid, the remainder continues in effect. Our failure to enforce a right does not waive it. You may not assign without our consent; we may assign freely. We are not liable for failures due to force majeure (acts of God, war, pandemic, technical failures of Roblox or third parties).
Severability: if any provision is held unenforceable, the remaining provisions remain in full force. No waiver of any breach will be deemed a waiver of any other or subsequent breach. Headings are for convenience only. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger or sale; you may not assign your account or rights without our prior written consent.
Force majeure: we are not liable for delay or failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, strikes, or failures of third-party services (including Roblox or hosting providers). We will use reasonable efforts to resume performance as soon as practicable.
